Practice Areas

Cross Kincaid offers trial support and consultation services in a variety of circumstances (law firms of all sizes, corporations, and individuals) on pretrial, trial, and post-trial strategy and procedure; preserving error in the trial court; preparing dispositive or significant motions at all stages of litigation; research and analysis of key legal issues.

If you need representation in Georgia state and federal appellate courts, Cross Kincaid provides hands-on experience from the trenches of the trial court (full bench and jury trials) to the view from the appellate court. Cross Kincaid’s 20+ years of hybrid appellate and trial practice provides the ideal vantage point for analyzing a case from start to finish.

Embedded Counsel/ Strategic Motions Practice

A federal courtroom

Complex legal issues require experienced advocacy.

The attorneys at Cross Kincaid have been trying high-profile cases and arguing complex appeals in the metro Atlanta area for years—there is almost nothing that Anna and Meredith have not encountered in a state or federal courtroom. When motions practice takes a wrong turn or when difficult legal issues arise, Cross Kincaid’s experience will keep your case on track. At Cross Kincaid, we know the law and how to apply it (or work around it) to strategically position the case for the best possible result for our clients.

When complex legal issues present themselves, Anna and Meredith can help you make the critical tactical decisions that maximize the value of your case. Too much time and expense goes into putting together a strong tort case to see it all unraveled by weak opposition to a motion to compel arbitration, an unexpected Daubert motion, or a creative summary judgment argument. Leave the legal heavy lifting (and writing) to Cross Kincaid.

Appellate Litigation

A high-value case rarely ends with a jury verdict.

Whether it is defending a favorable jury verdict or seeking reversal of a trial error, high stakes complex litigation often ends up in the appellate courts—sometimes more than once. When that happens, there is no substitute for experienced appellate counsel. Effective appellate advocacy is a decidedly specialized skill set; it can take lawyers unfamiliar with archaic and highly technical appellate rules months of frustration to learn the basics. Trust Cross Kincaid's decades of experience litigating throughout Georgia's state and federal appellate courts to protect your verdict or seek correction of an unfavorable ruling in the trial court. You won't regret it.

Medical Malpractice

Medical malpractice and negligent medical care can be devastating for victims and their families.

Cross Kincaid can guide you through claims involving misdiagnosis, birth injuries, surgical errors and nursing home neglect.

Victims and their families may be entitled to compensation for:

  • Medical bills and expenses;

  • Pain and suffering; and

  • Loss of present and future wages.

Clients can expect compassionate and thoughtful representation throughout the process, as Cross Kincaid helps victims achieve results.

Premises Liability & Wrongful Death

At times, someone other than the criminal shares legal responsibility for the victim’s injuries.

The failure of a property owner to ensure proper security (at apartment complexes, gas stations, hotels, stores, etc.), may entitle a victim to compensation if that owner:

  • Failed to hire a sufficient number of security officers

  • Failed to train security officers to effectively deter and respond to criminal activity

  • Failed to use or maintain access controls at entrances

  • Failed to use or maintain adequate lighting in common areas

  • Failed to address a history of criminal street gangs and drug dealers on the property

Cross Kincaid can help victims of assaults, muggings, sexual assaults, and shootings navigate these types of complex premises liability cases. We know how devastating being the victim of a crime can be, and we are here to help.

False Claims Act

Accountability for fraud against the government often requires the bravery of a whistleblower.

Under the False Claims Act, whistleblowers (also called “relators”) may file claims against individuals and entities for fraudulent, wasteful, or other abusive acts committed against the government.

The whistleblower may be eligible to receive a portion of the government’s damages recovered as a result of the whistleblower coming forward. Both federal and state law offer protection to whistleblowers so that they can feel safe coming forward with information.

Cross Kincaid can help whistleblowers navigate the False Claims Act’s specific, strict filing requirements to avoid potential hazards that could jeopardize your case.

Between Meredith’s experience representing parties on both sides of the aisle in False Claims Act matters, and Anna’s decades of experience as a prosecutor, Cross Kincaid is well equipped to represent whistleblowers in these types of claims of fraud against the federal and state governments.

White Collar Criminal & Regulatory Defense

Cross Kincaid identifies the strengths and weaknesses of the prosecution’s case to prepare a winning defense.

Anna spent decades as a highly successful and well-respected criminal prosecutor around the metro Atlanta area; Meredith effectively defended corporate and individual clients in complex federal criminal and regulatory probes. Those experiences allow Cross Kincaid to easily identify the strengths and weaknesses of the prosecution’s case and use them to their client’s advantage in preparing a winning defense. Cross Kincaid’s unique skill set offers strategic advantages in helping you navigate a government regulatory or criminal investigation.

Anna and Meredith have established trusting, professional relationships with the prosecutors and judges with whom they have long worked, giving them regular access to the prosecution and law enforcement before a charging decision is made.
